>> the family of a teenaged boy shot and killed by deputies while carrying a pellet gun is filing a federal lawsuit this morning. >> they said we have a bomb threat and we got off the plane pretty darn quickly. >> a united express flight from sfo to san antonio makes an unscheduled stop in phoenix after someone on the plane made a threat. from across the bay to around the world, the stories that matter on "kpix 5 news this morning." captions by: caption colorado comments@captioncolorado.com >> your realtime captioner is mrs. linda m. macdonald. good morning, it's friday, november 1. i'm michelle griego. >> hi, everyone. i'm frank mallicoat. it is 5:00. we begin with some breaking news right now. two construction workers are hit on interstate 680 in milpitas. this is a live video from the scene. you can see it's still very active. workers were killed. it happened just before 3:00 this morning in the northbound lanes before the scott creek road interchange. the contract workers for caltrans were doing emergency roadwork when a silver nissan hit the work truck on the side of the road there.

the driver of the car was taken to the hospital with life- threatening injuries. elizabeth wenger has more on the closure with "kcbs traffic." >> the accident is right there on the fremont-milpitas before scott creek. they have one right lane blocked off while they continue the investigation. chp at this point is not sure when they are going to be able to re-open that lane. we just got an update. still no official eto. delays continue to grow, right now backing up into milpitas looks like right there for just about one exit approaching jacklin road so if you are looking for an alternate, consider 880 in the meantime. we are also watching this accident southbound 101 approaching petaluma boulevard south. an accident involving a reckless driver. chp is on scene now blocking one lane. may see some delays there. and we still have a full freeway closure in effect in antioch 4 approaching loveridge, use the on-ramp to

get back on the freeway. this is your latest "kcbs traffic." a woman has life- threatening injuries after she was shot outside an apartment complex at 11:00 last night in hayward. it was on sleepy hollow avenue near west tennyson road. she is in the hospital and in surgery. two trick or treaters were taken to the hospital after a pickup truck hit them in the north bay. the 12- and 13-year-olds were struck at about 7:00 last night at cloverdale boulevard and healdsburg avenue in sonoma county. one boy was flown to the hospital with two broken legs. the other suffered shoulder and head trauma. police say the 75-year-old driver was not injured and is cooperating with investigators. 5:02. new details about the threat that forced a flight from sfo to san antonio to make an emergency landing. passengers taken off the united express flight after it landed in phoenix. officials say a threatening note was found on the plane. there were 46 people on the plane that was taken to a

above the average at 77 in livermore, 71 san francisco and about 76 degrees in san jose. cold front coming to town for the weekend. we'll have more on that in just a couple of minutes. happening today, one in seven americans will have less money for food as billions of dollars are cut from the federal food assistance program. kpix 5's anne makovec joins us from san francisco where the program's first across-the- board cuts are hiding hard. anne. reporter: yeah. imagine how much you spend at your local grocery store every month and imagine having hundreds of fewer dollars to spend starting today. that is what millions of americans are facing today because of these very large cuts that went into effect. and there could be more cuts coming. reporter: single mother lisa oates says she may run out of money next month trying to feed her two children. after losing her job she began

receiving $450 a month from the nation's food stamp program but she and another $47 million americans will soon see more than 5% cuts. >> i have to tell my 13-year- old, sorry hold off on that peanut butter and jelly sandwich we have to make that loaf of bread last, you know? you don't want to tell these kids that. >> reporter: congress included additional funding for the program in the 2009 stimulus bill but that expired which means a $5 billion cut in food stamp benefits nationwide. a family of three like lisa's will lose up to $29 a month. for others the loss could range from $11 to $36 for a family of four. valencia adams who oversees a nonprofit for low-income families in southern california worries the demand for food banks will spike. >> you're talking about families maybe having to decide about, you know, whether we pay the light bill, whether we pay all of the rent and could end up facing homelessness. >> reporter: lisa hopes a social worker can help her family find housing. they are temporarily living in a hotel. >> if you are struggling now, what will it be like with these

cuts? >> more struggles. you got to wake up every day and face it. >> reporter: and there could be more cuts coming. congress is debating that right now. in fact, the republican- controlled house is considering an additional cut of $4 billion from that program. live in san francisco, anne makovec, kpix 5. >> that program costs $80 billion a year, more than doubled over the last five years. a father faces child endangerment charges after being accused of leaving his kids locked up in an suv for more than 14 hours overnight. 29-year-old julio reyes of san jose was arrested on wednesday night. milpitas police say early that afternoon, a woman living on north hillview drive called 911. she said a ford explorer had been parked all night near her home and there were people inside it. officers arrived to find a 10- year-old girl and an 8-year-old boy inside. >> the children were very cold,

very tired, very hungry, and the officers took them into protective custody and brought them back here to the police station. >> police say reyes admitted he went to a friend's house and leavitt the kids in an suv behind. norovirus is blamed for sickening dozens of students who live on stanford's campus. the 52 students all ate at florence moore dining hall earlier this week. they complained about flu-like symptoms including vomiting and diarrhea. four were briefly hospitalized for dehydration. workers have been sanitizing the dining hall, common areas and the bathrooms in the complex. a janitor who stayed behind to help patients abandoned at a castro valley assisted care facility is speaking out about the conditions. he told the "contra costa times" he and a coworker were scrambling to help the patients. state officials closed the facility last week. the patients who were left behind are now staying somewhere else. the fbi and other law enforcement agencies are investigating if any charges will be filed. 5:07. today is the day bart workers

decide whether to accept their new contracts. members of two unions are voting on the contracts that were worked out last month ending the strike. the proposals include a 15% raise over four years. the seiu and the atu local unions plan to count the ballots as soon as the polls close tonight. they expect to give us results after 11:00 tonight. there are new rules for people working on railroad tracks here in the state of california. state puc now says there has to be someone whose only job is to be a lookout for other track workers. also, there has to be three-way communications involving the workers, train operators and a transit agency central control. changes follow last month's accident in which two workers were killed on bart tracks. in other headlines around the bay, starting today, red light cameras will be on the lookout for drivers making illegal turns at san francisco's busy market and octavia intersection. drivers often make illegal turns on to the central freeway there. it's been the scene of many

accidents involving pedestrians and cyclists. getting caught could cost you $238. tomorrow's the first saturday in november which marks the first day of dungeness crab season. this is only for people who fish for crabs recreationally. the commercial season starts november 15. we solved the case of the mysterious barge floating off treasure island. our ken bastida has confirmed the barge is a private google showroom. it's a story you'll only see here on kpix 5. reporter: a source familiar with the highly secretive project confirms it's been ongoing for more than a year spawned in the so-called google x division of the company, cloaked in secrecy even from most employees, but personally directed by google's cofounder sergey brin. a movable high-tech showroom for google projects and products reserved for only the most high level vips and tech geeks, essentially a four-story portable building constructed of interchangeable 40-foot

shipping containers that can be assembled and disassembled at will. it's designed to be placed on everything from barges to railcars and reassembled anywhere in the world. it could be at a ski resort one morning and on the beach at malibu days later. sources tell us it's google's multi-million dollar response to apple's highly successful apple store concept but with an invitation-only requirement. there is only one problem: the company was informed by the u.s. coast guard last summer that the structure, which is meant to contain three floors of dazzling showrooms and an upper party deck complete with lanais and bars, that it is in essence a floating vessel and subject to all applicable federal maritime regulations. construction appears stalled at present while google struggles to work within the coast guard's strict safety requirements. in the meantime, it sits moored in san francisco bay amid tight security.

plans to stop selling the sweater. hallmark sweater is trending on twitter this morning. also trending obama approval. the president's approval rating hit an all-time low in a new paul. cbs is considering a new "how i met your mother" spinoff. apple device goes on sale today and dell confirms it was selling a laptop that smelled like cat urine but fixed it. follow us on twitter at #cbssf. and updating you now on our breaking news in milpitas, an injury accident on northbound 680 continues to block at least one lane approaching scott creek. and these are once again a live look at the scene. it was a construction worker and another worker in a work truck. they were working to remove a sign on the shoulder when another driver rammed into that truck and one person was killed. another worker suffered minor injuries. so you can see the investigation out there now. and some of the delays beginning to grow on our sensors coming up northbound.

so it looks like the backups begin right around jacqueline in milpitas. the accident is on the fremont milpitas border. consider using 880 as an alternate while the investigation continues. better news for petaluma commuters. southbound 101 approaching petaluma boulevard south an accident involving a reckless driver. they were able to clear the accident over to the right-hand shoulder quickly. but we are just getting word of a new accident in the area. so we'll continue to watch that petaluma commute. overnight roadwork involving a full freeway closure. eastbound lanes of highway 4 approaching loveridge until 5:30 this morning. in the meantime, we are just beginning to see those delays growing in the westbound lanes. and our other problem spot usually this time of the morning as far as brake lights go is the commute out of the altamont pass. westbound 580 so far in the clear to the livermore valley only about 15 minutes between the altamont pass and the dublin interchange. bart systemwide on time should have 20 trains or more by now

all with everything on schedule. ace train one great start out of the central valley. if you have questions or updates on the milpitas accident once you hit the road tune to our partners, kcbs 740- am and 106.9-fm. that is your latest "kcbs traffic." over to lawrence now for the forecast. going to be the nicest day of the week at least the warmest outside as high pressure strengthens somewhat but we have some changes coming our way for the weekend. headed out the door a little chilly in spots. we have some 40s and 50s in most areas although down to the tupper 30s in some of the north bay valleys again. toward this afternoon, enjoying sunshine all the way to the beaches. mid-60s at the coastline 70s inside the bay today and even some mid- to upper 70s in some of the valleys. so that ridge of high pressure kind of maxing out today. looks like things are going to be changing. ridge breaks down on saturday and here comes a cold front sliding out of the gulf of alaska. not strong enough to bring rain but will bring some clouds and

cooler temperatures and the winds will be kicking up by saturday afternoon. warm temperatures around the state, lots of 70s, 77 degrees in fresno, 75 in sacramento. the high country looking very nice but if you are traveling there this weekend, be prepared for a big change in the weather. all right. around the bay today, you will see plenty of sunshine, 76 degrees in san jose. 75 in sunnyvale. 66 degrees in half moon bay. east bay numbers running into the mid- to upper 70s by the afternoon. and inside the bay should be a beautiful day. 71 degrees in san francisco. 74 in oakland. and 76 degrees in santa rosa. next couple of days including the weekend, changes as those temperatures going to start to take a nosedive as we head into saturday. maybe a bigger story will be the winds that will be picking up on saturday afternoon. clear on sunday but cooler. and then by next week, guys, i think late in the week, at least we start talking about a pattern change and the great karnow sees the possibility of a few showers. >> no. >> yes. it's going to happen!

it's going to happen at one point. >> we're listening. >> thank you. >> it is november. >> thank you, lawrence. it is 5:19 now. parents aren't the only ones having trouble with rebellious teenagers. facebook is now in a frenzy trying to keep its younger members from deactivating their accounts. the general attitude from teens is that facebook is so last year. more of them are now choosing newer social media apps and that means less supervision from parents who aren't up to speed with the latest technology. >> she's moved on to instagram and the other one snapchat or something. now they have moveed to other technology the parents haven't figured out yet. >> this trend is enough to spook some facebook investors. but a bright spot for the company is that its mobile users shot up some 45% from last year. well, media mogul oprah winfrey is selling items from several parts of her home, paintings, sculptures antique furniture, even scooters will be auctioned off all tomorrow.

one of those workers killed. it happened just before 3:00 this morning in the northbound lanes before the scott creek road interchange. the contract workers for caltrans were doing emergency roadwork when a silver nissan hit their work truck on the side of the road. the driver of the car taken to the hospital with life- threatening injurieses. elizabeth wenger has more on the closure on i-680. >> how long the lane will be shut down, at least one lane has been shut down since before 3:00 this morning approaching that scott creek road exit. it's actually right there on the border between fremont and milpitas. and our sensors continue to show a longer line of backups. speeds are super slow at some point under 20 miles per hour. it looks like it's jamming up towards at least 237. kpix 5 reporter cate caugiran just arrived on the scene of the breaking news this morning. cate, what's the latest details? >> reporter: liz, i can tell you as we were approaching this year here northbound 680 near scott creek road the traffic is

pretty heavy. i want to show you the scene now. take a look. there's a lot going on here. we know this happened just before 3:00 this morning. we do have some video that we shot from earlier as frank mentioned, two contract workers were moving a roadway sign just south of some emergency roadwork along the off-ramps. their truck was parked along the right-hand shoulder and that's when a silver nissan hit the back of the work truck. one worker was standing there at the time of the crash and was killed. the other was on the side and suffered some minor injuries. >> well, at this point, we're going to try to determine the reason for the collision, why the silver nissan left the roadway and collided with both contract workers as well as the vehicle and to find out if dui was a factor in this collision. >> reporter: chp says the driver of the nissan had to be removed from the car and was taken to the hospital in san jose with life-threatening

injuries. there were no witnesses to the accident. and at this point, no one else has been -- or no one in this accident has been identified. i was just told a few seconds ago, this is an active dui investigation. so again, they are going to be looking to that to see if that was a factor in this crash. reporting live in milpitas, cate caugiran, kpix 5. >> reporter: it's already been a busy friday morning commute in other parts of the bay area, as well. southbound 101 approaching petaluma boulevard south fortunately all lanes are open with that crash there. but it is still seeing some delays in the area because there must be some emergency crews on the shoulder. also, if you are heading towards the bay bridge toll plaza, so far things look good for the morning drive into san francisco. that is your latest "kcbs traffic." frank, michelle, back to you. >> elizabeth, thank you. we're following developing news in hayward. a woman is rushed to the hospital after she was shot outside an apartment complex. it happened at about 11:00 last night on sleepy hollow avenue near west tennyson road. she was taken to the hospital and is now in surgery.

>> these cuts will affect about 47 million americans. silicon valley talent is being tapped to fix the federal government's troubled healthcare website. michael dickerson a google engineer has been recruited to address numerous problems plaguing healthcare.gov. software companies oracle and red hat would also take part in the effort and as cbs news' susan mcginnis reports, newly obtained documents show enrollments got off to an incredibly slow start. reporter: the troubled healthcare.gov website hits its one-month anniversary today but no one in the white house is celebrating. newly obtained documents from cms, the agency running the site, revealed major problems from the start. through the first two days only 248 people had signed up for insurance. the notes also tell why including high capacity on the website, direct enrollment not working. >> while the website -- >> reporter: republicans this week grilled the head of cms to

find out what the current totals are. she wouldn't share even though the documents showed the government has access to them. >> no numbers on who is enrolled? you have no idea? >> we'll have those numbers available in mid-november. >> reporter: cbs news has confirmed insurance companies are telling more than 3 million americans they will soon lose their current policies because they don't meet new government requirements like maternity care and emergency visits. >> in many cases, the inability of an individual to in the keep their coverage is because their insurance company is phasing out their plan. >> reporter: the white house says many of those people will qualify for subsidies to offset the cost of new plans. susan mcginnis, cbs news, washington. >> the obama administration wants 7 million people to sign up by march 1. friday the all-important weekends is here. >> we have some changes i think today is going to be a great

no one was injured. the driver was ticketed. federal agents say they have closed off an elaborate tunnel built to smuggle drugs between tijuana, mexico, and san diego. it's incredible. they say the tunnel was equipped with lighting, ventilation and an electric rail system that linked warehouses in tijuana and the otay mesa industrial area in southern san diego. >> >> this complex undergrew every ground passageway zigzags for about a third of a mild under the border at a depth of approximately 35 feet. >> the tunnel was just completed underground but no drugs just made it through. federal agents seized 8.5 tons of marijuana and 327 pounds of cocaine from facilities related to the tunnel. three men are under arrest. canadian border officials stumbled upon a different kind of halloween surprise inside these pumpkins here. the gourds were in a passenger's luggage at the montreal airport stuffed with
